Fleetwood Seeks To Fend Off Formaldehyde Claimants

Law360, New York (October 26, 2009, 3:53 PM EDT) -- Fleetwood Enterprises Inc. has beseeched a bankruptcy judge to enforce an insurance policy pollution exclusion it says protects it from liability for claims over formaldehyde levels in emergency housing provided to hurricane victims.

In an adversary proceeding filed Friday in the U.S. Bankruptcy Court for the Central District of California, Fleetwood said that whether or not the claimants’ potentially $2 billion in claims is covered by its insurance policies will have a “significant effect” on the claims of other creditors whose claims may be legitimately covered....
