Calif. Can Regulate Washer Water Amid Crisis: 9th Circ.

Law360, New York (October 29, 2009, 3:04 PM EDT) -- A federal appeals court has ruled that the U.S. Department of Energy was wrong to block the California Energy Commission's efforts to set up efficiency standards for residential washing machines as part of a campaign to address the state's worsening water crisis.

A three-judge panel of the the U.S. Court of Appeals for the Ninth Circuit on Wednesday reversed and remanded an Energy Department order denying the commission's request for a waiver of preemption under the Energy Policy and Conservation Act.
