GHG Appellate Rulings Could Incite Insurance Brawls

Law360, New York (October 30, 2009, 6:32 PM ET) -- Two federal appeals court decisions that revived public nuisance suits aimed at greenhouse gas emitters could spur a flood of global warming suits, which in turn could spark fights with insurers over coverage for mounting legal costs, according to insurance lawyers.

The U.S. Courts of Appeals for the Second and Fifth circuits' decisions in September and October allowed suits against energy companies over their greenhouse gas emissions to proceed, rejecting arguments that the suits presented nonjusticiable political questions.
