11th Circ. Asks Ga. High Court For Insurance Law Input

Law360, New York (October 30, 2009, 6:58 PM ET) -- A federal appeals court has asked the Georgia Supreme Court to clarify three state insurance law questions stemming from a case in which an insurer denied defense coverage after discovery in an underlying Ponzi scheme-related lawsuit was nearly complete.

The U.S. Court of Appeals for the Eleventh Circuit certified the questions to Georgia’s highest court on Friday.

The underlying case stretches back to an elaborate $165 million Ponzi scheme more than a decade ago.
