PerkinElmer Had Duty To Promote Printing Unit: 1st Circ.

Law360, New York (November 2, 2009, 4:03 PM EST) -- A federal appeals court has ruled that medical and environmental technology manufacturer PerkinElmer Inc. had a duty to promote the failed computer-to-plate printing technology of Sonoran Scanners Inc., which PerkinElmer acquired in 2001 for $3.5 million.

The ruling, issued Thursday by the U.S. Court of Appeals for the First Circuit, reverses a finding by the U.S. District Court for the District of Massachusetts that PerkinElmer did not have an implied obligation to promote the scanning business under the terms of the purchase agreement.
