7th Circ. Revives 'Thomas & Friends' Photo Rights Suit

Law360, New York (November 05, 2009, 7:43 PM ET) -- A federal appeals court on Thursday revived a photographer's suit alleging HIT Entertainment and Learning Curve International Inc. infringed his copyright on product photos he took of their “Thomas & Friends” train toys.

The U.S. Court of Appeals for the Seventh Circuit found that the U.S. District Court for the Northern District of Illinois had incorrectly dismissed Daniel Schrock's suit, reversing and remanding it to the lower court for further proceedings.
