PacifiCare Loses Challenge Of Potential $1.3B Fine

Law360, New York (November 9, 2009, 3:01 PM EST) -- Finding that attorneys for the plaintiff tried to mislead him, a California judge has scrapped a suit brought by PacifiCare Life & Health Insurance Co. that challenged the California Insurance Code after the state charged the UnitedHealth Group Inc. unit with more than 100,000 violations in processing health insurance claims.

Judge James Chalfant of the Superior Court of the State of California, County of Los Angeles, tossed the suit Friday, the California Department of Insurance said in a statement.
