6th Circ. Tosses Challenge To TVA Reservoir Project

Law360, New York (November 10, 2009, 2:25 PM EST) -- A federal appeals court has dismissed a suit challenging the Tennessee Valley Authority's development of an 11,000-acre reservoir, finding that an association of property owners in the area did not establish that the construction of additional boating docks would injure its members directly.

The U.S. Court of Appeals for the Sixth Circuit ruled in favor of the TVA and the Tennessee Department of Environment and Conservation on Friday, affirming a district court ruling that the Friends of Tims Ford lacked standing to bring its suit....
