9th Circ. Strikes Blow Against Landfill Developer

Law360, New York (November 11, 2009, 5:54 PM EST) -- A federal judge's decision to nix a land exchange that would have paved the way for the nation's largest landfill to be built on public lands near Joshua Tree National Park has been mostly upheld by an appeals court.

The U.S. Court of Appeals for the Ninth Circuit affirmed 2-1 on Tuesday most of a summary judgment ruling for the green groups that have been fighting the proposed 4,654-acre landfill since the late 1990s.
