Rehabilitation Act Covers Contractor Claims: 9th Circ.

Law360, New York (November 20, 2009, 3:48 PM ET) -- A federal appeals court has ruled that the federal Rehabilitation Act covers discrimination claims brought by an independent contractor, siding against a medical center that allegedly failed to accommodate an anesthesiologist with sickle cell anemia.

The ruling by a three-judge panel of the U.S. Court of Appeals for the Ninth Circuit on Thursday reversed a lower court's summary judgment grant in favor of Yuma Regional Medical Center after finding that Dr. Lester Fleming, an independent contractor, was in fact protected by the statute.
