2nd Circ. Reverses Judgment For JPMorgan In FLSA Suit

Law360, New York (November 20, 2009, 6:26 PM EST) -- A federal appeals court has reversed a favorable ruling for JPMorgan Chase & Co. in an employment case challenging the bank’s classification of its loan underwriters as exempt from federal overtime requirements.

The U.S. Court of Appeals for the Second Circuit on Friday ruled that former underwriter Andrew Whalen did not fall under the administrative exemption in the Fair Labor Standards Act and reversed summary judgment for JPMorgan.
