US Blasts Ford Bid To Amend CIT Drawback Complaint

Law360, New York (November 23, 2009, 12:44 PM EST) -- The U.S. has lashed out at Ford Motor Co.'s second request to amend its complaint in the carmaker's U.S. Court of International Trade dispute over allegedly liquidated drawback claims, saying the proposed amendment to include more drawbacks would be futile.

Ford's motion for leave to add to the lawsuit all drawback claims Ford made prior to Dec. 3, 2004, which were not affirmatively liquidated by U.S. Customs and Border Patrol prior to Dec. 3, 2005, should be rejected, the U.S. said in the CIT on Friday....
