Class Certification Denied In Pottery Barn Kids Case

Law360, New York (November 15, 2006, 12:00 AM EST) -- Pottery Barn Kids Inc. has scored a major victory in its California wage and hour case, as the court has denied plaintiffs class certification.

The suit was filed on behalf of Pottery Barn Kids assistant store managers who alleged that they were improperly identified as executive employees, which made them exempt from California’s overtime pay requirements.

The proposed class would have included around 54 employees, according to court documents. Instead, the plaintiffs will consist of Sarah Thayer-Ogden and Shaunna Matson.
