Firm Denied Access To Insurer's Claims Files

Law360, New York (November 24, 2009, 6:03 PM EST) -- A family law firm accused of botching a divorce deal can't access claims files during discovery in a fight with its insurance company over coverage of the malpractice suit, a federal judge has ruled.

U.S. Magistrate Judge Dennis W. Dohnal of the U.S. District Court for the Eastern District of Virginia ruled Monday that Minnesota Lawyers Mutual Insurance Co.'s claims and underwriting files are privileged and not subject to discovery.
