Atser Wins Partial Reversal Of Misconduct Ruling

Law360, New York (November 25, 2009, 2:53 PM EST) -- In a suit accusing Raba-Kistner Infrastructure Inc. of infringing a construction-data collection patent, a federal judge has thrown out part of his ruling that found Atser Research Technologies Inc. had committed litigation misconduct, but an award of attorneys' fees for the defendant will stand.

In a strongly worded order on Tuesday, Judge Harry Lee Hudspeth of the U.S. District Court for the Western District of Texas reversed his previous decision finding Atser had failed to provide particularized infringement contentions in response to one of Raba-Kistner's interrogatories....
