NY Court OKs Brooklyn Nets Stadium Eminent Domain

Law360, New York (November 25, 2009, 3:14 PM EST) -- New York’s highest court has upheld the use of eminent domain to seize 22 acres of property in downtown Brooklyn for private development, giving a green light to real estate magnate Bruce Ratner’s planned $4.9 billion project to bring the National Basketball Association’s New Jersey Nets to New York City.

The Empire State Development Corp.’s exercise of its power of eminent domain was valid under the state’s constitution, the New York State Court of Appeals ruled in a 6-1 decision on Tuesday.
