Tyson Workers Win Class Certification In OT Suit

Law360, New York (December 1, 2009, 4:07 PM EST) -- A federal judge has given conditional certification to a class of workers accusing Tyson Foods Inc. of failing to pay proper overtime wages at a Tennessee processing facility.

In an order issued Nov. 25 in the U.S. District Court for the Middle District of Tennessee, Judge William J. Haynes Jr. dismissed the meat processing company's arguments against granting class status, and certified a class that could comprise more than 4,800 employees.
