Law360, New York (December 02, 2009, 3:15 PM ET) -- The judge overseeing a multidistrict litigation against Netflix Inc. and Wal-Mart Stores Inc. has thrown out two putative class actions brought by subscribers to Blockbuster Inc.'s online DVD rental service who claimed Blockbuster overcharged them because of an unlawful market allocation deal between the defendants.
Judge Phyllis Hamilton of the U.S. District Court for the Northern District of California on Tuesday granted the defendants' July 21 motion to dismiss the cases for lack of standing.
