Respondents Wrongly Limited In ITA Order Review: CIT

Law360, New York (December 2, 2009, 5:30 PM EST) -- The U.S. Court of International Trade has ruled that the Department of Commerce unlawfully limited the number of individually examined respondents in a review of an anti-dumping duty order on stainless steel bar imports from India, which arose from an investigation initiated by Carpenter Technology Corp. and others.

The CIT issued an opinion and order Nov. 23 partially granting the plaintiffs' challenge to a final determination issued in 2007 by the International Trade Association in an administrative review.
