Roche Wins Transfer Of Novartis’ Patent Case To NC

Law360, New York (December 3, 2009, 5:13 PM EST) -- A federal appeals court has found that a Texas district court erred when it refused to transfer to North Carolina a patent infringement case brought by Novartis Vaccines and Diagnostics Inc. against Hoffman-La Roche Inc. and its HIV fusion inhibitor Fuzeon.

The U.S. Court of Appeals for the Federal Circuit on Wednesday accepted Roche’s petition for a writ of mandamus and directed the U.S. District Court for the Eastern District of Texas to promptly turn over the patent dispute to the Eastern District of North Carolina....
