Harman Mining Again Asks Court To Review Massey

Law360, New York (December 03, 2009, 4:34 PM ET) -- Down but apparently not out, embattled mining company owner Hugh Caperton has again appealed a decision overturning a $50 million verdict against Massey Energy Co. for helping to drive him out of business.

In one of several moves fighting the dismissal of the award, Caperton's attorneys argued in a new filing that the decision from the West Virginia Supreme Court of Appeals overturned settled state law and improperly dismissed their claims on a technicality without giving them the chance to refile, according to a petition for...
