Law360, New York (November 17, 2006, 12:00 AM ET) -- Swiss company Alcon Inc. has aimed a patent infringement suit at Canadian generic drug maker Apotex Inc. over its move to sell a generic of top-selling eye allergy drug Patanol.
Alcon, the largest eye-care company in the world, and its Japanese partner Kyowa Hakko Kogyo Co. Ltd. filed the suit in the U.S. District Court for the Southern District of Indiana on Wednesday to block Apotex from making and selling the generic before Alcon’s patent expires in 2015.
