2nd. Circ. Ruling Extends Charbucks Trademark Spat

Law360, New York (December 3, 2009, 7:33 PM EST) -- A federal appeals court has again revived a trademark dispute between coffee behemoth Starbucks Corp. and a mom-and-pop New Hampshire coffee company that sells a Mister Charbucks coffee blend, saying that the district court erred in ruling against Starbucks on its dilution-by-blurring claims.

The U.S. Court of Appeals for the Second Circuit on Thursday remanded part of Starbucks case against Wolfe's Borough Coffee Inc. to the U.S. District Court for the Southern District of New York, as it did in February 2007.
