Target Counsel 'Desperate' In Gazebo Import Spat: US

Law360, New York (December 3, 2009, 6:32 PM EST) -- The U.S. has accused counsel for Target Corp. of staging a “desperate” and “inappropriate” attempt to wrongly influence the U.S. Court of International Trade in the wake of a trial over tariffs on the retailer's imports of gazebos from China.

Attorney Michael V. Cerny's Nov. 20 letter to the court explaining the disassembling of one of his client's exhibits after trial is “inadmissible hearsay”and “not sworn testimony by a fact witness taken in open court,” the U.S. said in a response Tuesday.
