H&R Block, Jackson Hewitt Seek Stay Pending Bilski

Law360, New York (December 8, 2009, 3:20 PM EST) -- Rivals H&R Block Tax Services LLC and Jackson Hewitt Tax Service Inc. are asking a federal judge to stay a patent infringement suit between them until the U.S. Supreme Court issues its decision in In re Bilski.

The companies said the high court's decision may affect the test a magistrate judge used to find two of the three H&R Block patents-in-suit invalid, according to a joint stay motion filed Monday in the U.S. District Court for the Eastern District of Texas.
