W.Va. Wind Farm Work Halted To Protect Bat Habitat

Law360, New York (December 9, 2009, 1:25 PM EST) -- Invenergy LLC, which is building a wind farm in West Virginia, has been ordered to leave the project unfinished following a federal judge’s ruling that the development could harm the endangered Indiana bat.

Judge Roger Titus of the U.S. District Court for the District of Maryland ruled Tuesday that Invenergy could not build 82 of the 122 turbines planned for the Beech Ridge project in Greenbrier County, W.Va., and that the 40 now under construction could operate only at winter when the bats were hibernating....
