Ohio Residents Appeal CSX Toxic Train Crash Ruling

Law360, New York (December 10, 2009, 3:29 PM EST) -- A group of Ohio residents that filed a putative class action alleging a CSX Transportation Inc. train that derailed near Painesville, Ohio, exposed the area to harmful dioxins is appealing the dismissal of its complaint to the U.S. Court of Appeals for the Sixth Circuit.

A notice of appeal was filed Wednesday in the U.S. District Court for the Northern District of Ohio seeking to overturn the court's dismissal of the plaintiffs' strict liability, negligence and medical monitoring claims against CSX.
