Judge Rebuffs Teva Discovery Bid In Aricept IP Suit

Law360, New York (December 10, 2009, 2:09 PM EST) -- A federal judge has rejected a bid by Teva Pharmaceutical Industries Ltd. to look at communications between Eisai Co. Ltd. and the U.S. Patent and Trademark Office, in a patent dispute over Teva's plan to make a generic version of Eisai Alzheimer's drug Aricept.

Magistrate Judge Esther Salas of the U.S. District Court for the District of New Jersey ruled Tuesday that Teva's discovery request was too broad.
