Cephalon Files 3rd Suit Over Planned Generic Nuvigil

Law360, New York (December 16, 2009, 5:29 PM EST) -- The number of generics makers sued by Cephalon Inc. for planning to create allegedly infringing generic versions of its narcolepsy drug Nuvigil has climbed to three, now that Mylan Pharmaceuticals Inc. has become latest target.

Cephalon filed suit against Mylan on Friday in the U.S. District Court for the District of Delaware, alleging that Mylan's abbreviated new drug application infringes two Cephalon patents.

The suit against Mylan follows similar suits by Cephalon in the District of Delaware against Actavis Group on Dec. 8 and Teva Pharmaceuticals...
