Hot Fuel Defendants Lose Bid To Toss MDL

Law360, New York (December 16, 2009, 7:25 PM ET) -- A group of defendants in multidistrict litigation over motor fuel temperature sales practices — including 7-Eleven Inc., Wawa Inc. and Marathon Petroleum Co. LLC — has failed to persuade a judge that the case is rife with political issues reserved for U.S. Congress and should be dismissed.

Judge Kathryn Vratil of the U.S. District Court for the District of Kansas handed down her ruling on Dec. 3, writing that the plaintiffs had pointed out "many substantial flaws" in the defendants' argument.
