Butterball Poultry Workers Win Cert. In FLSA Action

Law360, New York (December 17, 2009, 1:39 PM EST) -- A federal judge has certified a collective action filed by former employees of poultry producer Butterball LLC alleging that the company didn't pay them for time spent donning and doffing equipment.

Judge Leon Holmes of the U.S. District Court for the Eastern District of Arkansas ruled Tuesday that the plaintiffs had met the standards for collective action certification under the Fair Labor Standards Act, but not under Arkansas' Minimum Wage Act.
