Insurer Wants Dismissal In Waste Case Coverage Spat

Law360, New York (December 18, 2009, 5:38 PM ET) -- Chartis Specialty Insurance Co. has asked a court to dismiss it from a suit brought by TIG Insurance Co. in a battle over defense costs for a Smithfield Foods Inc. subsidiary accused of allowing odors and manure runoff from hog farms to contaminate neighboring properties.

In a motion filed Thursday in the U.S. District Court for the Western District of Missouri, Chartis said the policy at issue in the third-party complaint has been exhausted by payments already made in connection with some of the underlying cases...
