FLSA Claim Nixed In Enviro Police Officers' Wage Suit

Law360, New York (December 18, 2009, 5:27 PM EST) -- A federal judge has ruled that Rhode Island's environmental agency did not violate the Fair Labor Standards Act when it failed to pay environmental police officers for still being on call during their lunch breaks.

But Judge Mary Lisi of the U.S. District Court for the District of Rhode Island dismissed the claim Wednesday only because the state could not be sued in federal court under the doctrine of sovereign immunity, and chastised the government for not pursuing the case in state court.
