Vt. High Court Hands Entergy Win In Emissions Suit

Law360, New York (December 22, 2009, 5:11 PM EST) -- Vermont's highest court has upheld a decision allowing a nuclear power plant owned by Entergy Corp. to release heated water into the Connecticut River, and overturned new requirements on how the plant monitors its emissions.

In an appeal from the state's Environmental Court, the Vermont Supreme Court on Friday rejected arguments from environmental groups and allowed Entergy to go ahead with water release plans for its Vermont Yankee nuclear power plant, even without extra monitoring.
