Duke Energy Shells Out $93M Over Ind. Coal Plant

Law360, New York (December 22, 2009, 3:19 PM EST) -- Duke Energy Corp. has agreed to pay about $93 million to settle a long-running dispute over a polluting Indiana coal plant, seven months after a jury found it liable for violating the Clean Air Act.

Duke will spend the bulk of the settlement amount — about $85 million — to reduce pollution at its Gallagher coal-fired plant in New Albany, Ind., the U.S. Environmental Protection Agency said Tuesday.
