Virgin Islands Off Hook For Fraud In CERCLA Suit

Law360, New York (January 7, 2010, 4:12 PM EST) -- A federal judge has tossed an alumina factory owner's fraud and conspiracy counterclaim against the U.S. Virgin Islands in a dispute over cleanup costs for hazardous materials dumped into one of the territory's main sources of fresh water.

Judge Harvey Bartle III of the U.S. District Court of the U.S. Virgin Islands on Tuesday granted a motion by the Virgin Islands and its Department of Planning and Natural Resources to dismiss the counterclaim.
