2nd Circ. Tosses Sanctions Against Cravath Attys.

Law360, New York (January 8, 2010, 6:20 PM EST) -- A federal appeals court on Friday overturned sanctions imposed on defense counsel from Cravath Swaine & Moore LLP for making factual representations without support in a class action accusing Royal Dutch Petroleum Co., the parent company of Shell Oil, of human rights abuses in Nigeria.

The U.S. Court of Appeals for the Second Circuit said the sanctions were wrongly assessed because the statements made by the defense attorneys could legitimately be supported by the evidence in the case, and thus did not meet the standards met...
