Circuit City WARN Claims To Be Tackled In Bankruptcy

Law360, New York (January 11, 2010, 4:15 PM EST) -- A bankruptcy judge has ruled that Circuit City Stores Inc. employees alleging violations of the Worker Adjustment and Retraining Notification Act should have their claims adjudicated through the claims administration process.

In a decision Thursday, Judge Kevin R. Huennekens of the U.S. Bankruptcy Court for the Eastern District of Virginia agreed with Circuit City that the best place to adjudicate whether the plaintiff is entitled to back pay under the WARN Act is in the bankruptcy claims allowance and disallowance process rather than in an adversary...
