Bus Drivers In FLSA Suit Win Preliminary Cert.

Law360, New York (January 12, 2010, 6:20 PM EST) -- A federal judge has granted preliminary collective certification in a suit in which school bus drivers and dispatchers in Little Rock, Ark., allege their employer, First Student Inc., violated the Fair Labor Standards Act by failing to pay them overtime.

Judge Susan Wright of the U.S. District Court for the Eastern District of Arkansas granted the certification on Monday. Putative class members will now have to opt into the lawsuit, and about 100 employees had already done so as of the filing of the plaintiffs' motion,...
