Fed. Circ. Denies En Banc Hearing Over Judges' Pay

Law360, New York (January 15, 2010, 7:18 PM EST) -- The U.S. Court of Appeals for the Federal Circuit has denied an en banc hearing to eight current and former federal judges contesting their judicial pay but has issued a summary affirmance order allowing them to petition directly to the U.S. Supreme Court.

The appellate court on Friday denied the en banc hearing to the judges, who are seeking back pay and declaratory relief because they haven't received the cost-of-living salary increases they say they're entitled to under the Ethics Reform Act of 1989.
