Contractor's Dust-Control Patents Nixed Over Conduct

Law360, New York (January 21, 2010, 3:06 PM ET) -- A federal judge has ruled that three dust-control patents Texas construction contractor CCC Group Inc. asserted against Martin Engineering Co. are unenforceable for inequitable conduct before the U.S. Patent and Trademark Office.

Judge Richard P. Matsch of the U.S. District Court for the District of Colorado said Tuesday that the parties involved in obtaining the patents intentionally misled the patent office and that Martin was entitled to attorneys' fees.
