Nike Told To Pay Up For Patent Suit Misconduct

Law360, New York (January 22, 2010, 4:32 PM ET) -- Although a jury concluded that Nike Inc. did not infringe an inventor's patent for a vented baseball cap, a judge has ordered the sportswear giant to pay the plaintiff more than $400,000 in attorneys' fees because of litigation misconduct by Nike during the trial.

Judge Joseph F. Bataillon of the U.S. District Court for the District of Nebraska on Wednesday granted a motion for attorneys' fees filed by inventor Gerald Kellogg for his expenses related to defending against Nike's counterclaim of invalidity, which the company voluntarily...
