7th Circ. Gives Shelter To Failed LearJet Class Suit

Law360, New York (January 25, 2010, 5:44 PM EST) -- The U.S. Court of Appeals for the Seventh Circuit has reversed an Illinois district court ruling that stripped a failed class action against LearJet Inc. of federal jurisdiction, finding that the lower court misinterpreted the Class Action Fairness Act.

The Seventh Circuit said Friday that the act of denying class certification does not automatically mean that a case loses its jurisdiction in federal court, siding with plaintiff Cunningham Charter Corp. in the matter.
