9th Circ. Kills UFW Pesticide Case

Law360, New York (January 26, 2010, 7:59 PM EST) -- Citing jurisdictional grounds, a federal appellate court has upheld the dismissal of a case brought by the United Farm Workers of America against the U.S. Environmental Protection Agency over continued use of the pesticide azinphos-methyl.

In a split decision on Tuesday, the U.S. Court of Appeals for the Ninth Circuit held that the U.S. District Court for the Western District of Washington was not an appropriate venue and that no timely petition is now possible, effectively killing the union's challenge.
