Claims Trimmed In Calif. Toxic Waste Suit Against Pepsi

Law360, New York (January 28, 2010, 4:46 PM EST) -- A federal judge has dismissed “preconception exposure” and two other claims from a suit brought against Pepsi Americas Inc. by people who allege they were injured by hazardous waste from a Willits, Calif., plant the company now owns.

Judge Susan Illston of the U.S. District Court for the Northern District of California on Tuesday granted Pepsi's motion for summary judgment against claims of toxic exposure before birth asserted by 12 of the 28 plaintiffs in the case.
