Par, Fleming Drop Spat Over Nasal Spray Patent

Law360, New York (January 28, 2010, 1:25 PM ET) -- Par Pharmaceutical Inc. has agreed to drop a suit it filed against Fleming & Co. Pharmaceuticals claiming the rival drug company infringed its patent and intentionally misled consumers with the marketing of its prescription nasal spray, CaloMist.

With a single handwritten line, Judge Rodney W. Sippel of the U.S. District Court for the Eastern District of Missouri on Wednesday signed off on a stipulation the parties filed indicating they would dismiss their claims with prejudice.
