CIT Rebuffs Ford's Judgment Bid In $2M Export Tax Row

Law360, New York (January 28, 2010, 4:12 PM ET) -- Ford Motor Co. has lost its bid to force the U.S. government to refund $2.3 million in harbor maintenance taxes the automaker paid between 1987 and July 1990, which the Supreme Court subsequently deemed unconstitutional.

In a ruling Wednesday, Judge Leo M. Gordon of the U.S. Court of International Trade shot down Ford's motion for partial summary judgment, saying he couldn't identify any genuine issues of material fact that precluded entry of judgment in favor of U.S. Customs and Border Protection.
