Massey Fights To Oust Protesters From W.Va. Mine

Law360, New York (February 02, 2010, 5:31 PM ET) -- A Massey Energy Co. unit has won a temporary restraining order in its effort to keep tree-climbing environmental protesters away from a West Virginia coal mine, scoring a victory ahead of the company's planned request for a preliminary injunction against the protesters.

The subsidiary, Marfork Coal Co. Inc., is expected to seek a preliminary injunction Thursday from Judge Irene C. Berger of the U.S. District Court for the Southern District of West Virginia, in a suit brought against five protesters at the mining company's Beetree Surface...
