DataTern Drops WaMu From Database Patent Case

Law360, New York (February 3, 2010, 4:02 PM EST) -- DataTern Inc. has dropped Washington Mutual Inc. from its infringement suit targeting more than a dozen companies over a patent related to database access systems, having received no response from the bankrupt financial institution in months.

DataTern filed a motion to dismiss WaMu without prejudice Tuesday in the U.S. District Court for the Eastern District of Texas, citing the fact that the defendant had neither answered the complaint nor filed a motion for summary judgment since returning a summons in June 2009.
