10th Circ. Grants Mandamus In 'Novel' Jury Access Bid

Law360, New York (February 4, 2010, 4:03 PM EST) -- A federal appeals court has issued a limited writ of mandamus ordering a district court to explain why it denied a lawyers association's request to interview a jury that found Sunoco Inc. liable for employment discrimination in 2005.

Calling the matter precedential, the U.S. Court of Appeals for the Tenth Circuit said Wednesday the question of whether a jury's right to privacy outweighs an educational group's First Amendment right to information requires more than the “terse” denial it received from the lower court.
